On 7th May 1858, he went to visit his married sister, Mrs
Mackerill, who lived in Todmorden with her husband and her
brother-in-law, John Mackerill.
Whilst at her house, he stole £60, which Mackerill kept
in a drawer at the house.
Returning to Rochdale, Cunliffe persuaded an
acquaintance, John Ashworth, to run away with him, and the 2
left for Wales.
Some days later, Ashworth went on to Swansea,
and Cunliffe discovered that he had stolen £52 2/6d of
the money, and Cunliffe returned home, where he was arrested.
At the Rochdale Petty Sessions, it was decided that, since the crime
was committed on the Yorkshire side of Todmorden,
that Cunliffe be tried there
